California Cannabis Laws 2026: What You Need to Know

California has one of the oldest legal cannabis markets in the country. In 1996, California became the first state to legalize medical cannabis when voters passed the Compassionate Use Act. Twenty years later, voters approved Proposition 64, legalizing cannabis for adults 21 and older. Adult-use sales officially began in 2018.

Today, both medical and recreational cannabis are legal in California, but that doesn't mean cannabis is treated like any other legal product. California cannabis laws operate at both the state and local levels, so rules can differ from city to city.

If you’re curious about California cannabis regulations—and want to stay on the right side of the law —this ultimate guide is the resource you need. Just remember: rules change all the time and can vary by location. Always keep up to date on local, state, and federal cannabis law.

Is cannabis legal in California?

Cannabis is legal in California for both recreational and medical use. Adults 21 and older can legally purchase, possess, and consume cannabis without a medical recommendation. Adults 18 and older can purchase medicinal cannabis with a valid physician's recommendation.

Cities and counties can decide whether to allow particular types of cannabis businesses and can establish local zoning, licensing, and operating requirements. This is why you may find several dispensaries in one California city and none in the neighboring community.

Statutes, Regulations, and Ordinances

Proposition 64 introduced an extensive regulatory framework that spans the state through statutes and regulations. The law allows the 58 counties and 483 cities to create their own cannabis-related ordinances.

Understanding California cannabis rules is easier when you understand the three different types of laws governing the industry.

Statutes

Statutes are laws passed by the California Legislature and signed into law by the governor. They establish statewide legal requirements.

The primary statute regulating California's commercial cannabis industry is the Medicinal and Adult-Use Cannabis Regulation and Safety Act (MAUCRSA), found in Division 10 of the California Business and Professions Code.

Consumer cannabis laws are also found in the California Health and Safety Code. This includes rules establishing legal possession, cultivation, and medical cannabis limits.

Regulations

Regulations are more specific rules created by state agencies to implement and enforce statutes. The Department of Cannabis Control creates regulations governing California's regulated cannabis industry.

These rules cover everything from licensing and retail sales to testing, packaging, track-and-trace, and enforcement. Current DCC cannabis regulations are contained in Title 4 of the California Code of Regulations, sections 15000 through 17905.

Ordinances

Ordinances are laws created by individual cities and counties. Local ordinances determine many practical details for legal cannabis businesses, including zoning, operating requirements, and whether certain types of cannabis businesses are allowed at all. A city's ordinance only applies within that city, while county ordinances generally govern unincorporated areas.

California also has cannabis equity ordinances. These local programs are intended to help people and communities disproportionately affected by cannabis prohibition participate in the regulated cannabis market. Depending on the jurisdiction, programs may provide expedited licensing, business assistance, or financial support.

Where can you use cannabis?

Cannabis consumption is generally limited to private property, except in locally authorized consumption areas. Public consumption is typically prohibited, including anywhere tobacco smoking is prohibited.

Personal possession

Adults 21 and older may possess up to 28.5 grams of cannabis or eight grams of

concentrate. Possessing more can result in a misdemeanor punishable by up to six months in jail and/or a $500 fine.

Medical patients may generally possess up to eight ounces of dried cannabis, with higher amounts permitted when medically necessary under a physician's recommendation.

Personal cultivation

Adults 21 and older may grow up to six cannabis plants per private residence for personal use. Cities and counties can impose reasonable restrictions on where and how those plants are grown.

Medical patients may grow up to six mature cannabis plants or 12 immature plants. However, if a physician deems more plants are needed to meet a specific medical need, it’s possible the plant count could legally be increased.

Growing more than the adult-use limit can result in penalties, including a fine of up to $500 and/or six months in jail.

Driving with cannabis

Cannabis can be transported legally in California, but an open container or package cannot be kept in the passenger compartment. Keep cannabis sealed or stored in the trunk.

Consuming cannabis while driving and driving while impaired are illegal.

On-site consumption

Cities and counties can allow licensed cannabis retailers to operate on-site consumption areas where adults 21 and older can consume cannabis.

Local governments decide whether to permit these businesses, so cannabis lounges aren't available everywhere. When it comes to legal pot in California, a lot can differ city to city.

California's AB 1775, passed in 2026, allows locally approved cannabis consumption lounges to also prepare and sell nonalcoholic, non-cannabis food and beverages and host live events, subject to local approval.

How to purchase legal cannabis

Adults 21 and older can purchase cannabis products from a state-licensed dispensary, like embarc, with valid government-issued ID. Medical consumers 18 and older need the appropriate medical documentation.

With 20 locations, you can find embarc dispensaries across California to secure your favorite cannabis goods. Remember, you can purchase 28.5 grams of non-concentrated cannabis and eight grams of concentrate per day.
